Since 2001 TRS has assisted over 70 tenants select the right Designer and Contractor to facilitate a fit- out on behalf of our clients.
Selecting the right contractor for your fit-out is critical in terms of design capabilities, budget controls and variation limitations coupled with timely delivery.
Liabilities
Fit-outs in Australia are very expensive and therefore tenants deserve the right to know what they are getting in return for their investment and who is ultimately responsible.
Some contractors offer low-cost fit-out solutions and then throughout the project apply a wide range of "Client Variations" thereby raising the price of the entire project in some cases beyond market prices and blaming the client for design omissions.
Therefore one of the most important factors in selecting a Contractor is determining the true extent of their liabilities to you as a Client.
Legal Opinion
On the advice of several reputable Law Firms in Australia, TRS recommends the Design & Construct (D&C) delivery method for fitouts - this is where the Contractor is solely responsible and liable for all consultants and trades including:
- Council Approvals and Administration
- Design
- Building Engineering Services (Mechanical, Electrical, Hydraulic)
- IT Solutions
- Selection of all materials
- Construction
- Handover and Certification
- Defects
The Contractor is paid a Lump Sum for completing the entire Design and Construction project and managing all sub-contractors and trades. The sum is not adjusted to take into account any change in the extent of work from that estimated by the contractor at the time of contracting. The contractor therefore carries the risk of correctly estimating, at the time of contracting, the extent of work required to be carried out.
In addition to the above there are no additional Consultant's fees (ie: Designers, Engineers, Project Managers, Council Approvals etc) as all costs are incorporated within the predetermined sum.
Do you need an Independent Project Manager?
Under the D&C delivery method the answer is "No." Any reputable Contractor will have a Senior Project Manager responsible for the project and who will report directly to the Client. Therefore paying additional consultant fees for a Project Manager is money that would be better applied to your fit-out.
How can Independence be guaranteed?
To ensure that budgets are correct, the Contractor's Project Manager is working to your requirements and that the fit-out will be delivered in accordance with certifications, financials and delivery schedules you should appoint a reputable independent Quantity Surveyor.
The QS will guarantee that the entire process is delivered in accordance with your requirements.
